The rules that apply when you use MK Network Inc.’s website, recruiting opportunities, and career coaching information.
These Terms & Conditions (“Terms”) are a legal agreement between you and MK Network Inc. (“MK Network,” “we,” “us,” or “our”). They govern your use of mknetworkinc.com and related online features. Separate written agreements may apply to paid recruiting or coaching engagements; if they conflict with these Terms, the separate agreement controls for that engagement.
1. Acceptance of these Terms
By accessing or using the website, submitting an inquiry or application, or using an online feature, you confirm that you have read and agree to these Terms and our Privacy Policy. If you do not agree, do not use the website.
2. What MK Network provides
MK Network offers talent recruiting, candidate sourcing, job-opportunity information, and career coaching. Website content is provided for general information and to facilitate introductions and services. Availability, features, job listings, and services may change at any time.
No website content forms an employment, agency, partnership, fiduciary, or other relationship unless a separate written agreement expressly says so.
3. Eligibility and authority
You must have legal capacity to accept these Terms. If you use the website for an organization, you confirm that you are authorized to bind that organization. A parent or legal guardian must authorize use by anyone who cannot legally agree on their own behalf.
4. Recruitment and job applications
- Job listings may be supplied by third-party employers. We try to present information accurately but do not guarantee that a listing is complete, current, error-free, or still available.
- Submitting an application does not guarantee review, contact, an interview, an offer, placement, or employment.
- Hiring decisions, employment terms, workplace practices, and employer representations are controlled by the applicable employer, not MK Network, unless clearly stated otherwise.
- You are responsible for the accuracy and lawfulness of your application. Do not misrepresent qualifications, identity, work authorization, or experience.
- You authorize us to use and disclose application information for recruitment as described at the point of collection and in our Privacy Policy. We will seek consent before presenting you to a prospective employer where required.
- You must independently evaluate an opportunity and employer before accepting employment or sharing additional sensitive information. Never send money or financial credentials in response to an unexpected recruitment request.
5. Career coaching
Coaching is educational and strategic support. Results depend on many factors outside our control, including your decisions, effort, market conditions, employer needs, and third parties. We do not guarantee interviews, offers, promotions, compensation, business results, or any other outcome.
Coaching is not legal, immigration, financial, medical, psychological, or other regulated professional advice. You remain responsible for decisions and should consult an appropriately qualified professional when needed. Fees, cancellations, rescheduling, deliverables, and refunds for paid services are governed by the applicable proposal, booking terms, invoice, or service agreement.
6. Recruiting and employer clients
Business clients are responsible for lawful and non-discriminatory hiring practices, accurate role and company information, authority to request recruiting services, and appropriate handling of candidate information. A client may use candidate information only for legitimate recruitment and employment purposes, must protect it, and must comply with applicable privacy, employment, human-rights, and anti-spam laws.
Commercial terms, fees, replacement periods, exclusivity, ownership of introductions, and payment obligations are governed by the client’s separate written agreement with MK Network.
7. Acceptable use
You may not:
- use the website unlawfully, fraudulently, deceptively, or to harm another person;
- submit false, infringing, discriminatory, defamatory, malicious, or unauthorized content;
- impersonate another person or misrepresent affiliation, authority, qualifications, or an employment opportunity;
- scrape, harvest, copy, index, or use automated means to extract listings, candidate information, contact details, or website content without written permission;
- probe security, bypass access controls, introduce malware, interfere with operation, overload the website, or attempt unauthorized access;
- use information obtained through the website for unsolicited marketing, harassment, surveillance, or unlawful discrimination; or
- reproduce or commercially exploit the website except as expressly permitted.
8. Your submissions
You retain ownership of material you submit. You give MK Network a non-exclusive, worldwide, royalty-free licence to host, copy, format, transmit, and otherwise use that material only as reasonably necessary to operate the website, provide requested services, conduct authorized recruiting, comply with law, and protect our rights.
You confirm that you have the right to submit the material and that our permitted use will not violate another person’s rights. Do not submit confidential information belonging to a current or former employer, trade secrets, or personal information about others unless you are authorized to do so.
Testimonials, photographs, recordings, or case studies will be used publicly only with appropriate permission. We may remove submissions that violate these Terms or create legal, security, or operational risk.
9. MK Network intellectual property
The website and its original text, design, branding, graphics, selection, and arrangement are owned by or licensed to MK Network and protected by intellectual-property laws. We grant you a limited, revocable, non-transferable licence to access the website for personal or internal business purposes consistent with these Terms.
You may not reproduce, modify, distribute, sell, sublicense, publicly display, create derivative works from, or remove proprietary notices from our content without prior written permission, except where law expressly allows. Third-party names and marks belong to their respective owners and do not imply endorsement.
10. Third-party services and links
The website may link to Calendly, WhatsApp, LinkedIn, Instagram, employer sites, and other third-party services. We do not control and are not responsible for their content, security, availability, terms, privacy practices, representations, or transactions. A link is provided for convenience and does not necessarily constitute endorsement. Your use of a third-party service is at your own risk and subject to its terms.
11. Privacy and electronic communications
Our Privacy Policy explains how we handle personal information. By providing contact information, you consent to service-related communications necessary to respond to your inquiry, application, or engagement. Marketing communications will be sent only where consent or another lawful basis exists, and you may unsubscribe as described in the message or Privacy Policy.
12. Disclaimers
To the fullest extent permitted by law, the website and its content are provided “as is” and “as available.” MK Network disclaims all representations, warranties, and conditions, express, implied, statutory, or collateral, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and freedom from harmful components.
We do not warrant that the website will be uninterrupted or error-free, that defects will be corrected, or that any information, employer, candidate, opportunity, advice, or result will meet your requirements. Nothing in these Terms excludes a warranty or right that applicable law does not permit us to exclude.
13. Limitation of liability
To the fullest extent permitted by law, MK Network and its directors, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, revenue, opportunities, data, goodwill, or anticipated savings; employment decisions or outcomes; or losses arising from third parties, even if advised of the possibility.
To the fullest extent permitted by law, our total aggregate liability arising from the website or these Terms will not exceed the greater of CAD $100 and the amount you paid MK Network specifically for the website feature giving rise to the claim during the six months before the event. Limits in a separate paid-service agreement control for that service.
These exclusions and limits apply regardless of legal theory but do not apply to fraud, wilful misconduct, or liability that cannot lawfully be limited.
14. Indemnity
To the extent permitted by law, you will indemnify and hold harmless MK Network and its directors, officers, employees, contractors, and agents from third-party claims, losses, liabilities, damages, judgments, costs, and reasonable legal fees arising from your unlawful use of the website, your material breach of these Terms, content you submit, or your violation of another person’s rights. This obligation does not apply to the extent a claim results from MK Network’s own negligence or misconduct.
15. Suspension and termination
We may restrict or end access to the website where reasonably necessary to address a Terms violation, suspected fraud, security risk, legal requirement, harm to another person, or operational need. Provisions that by their nature should survive will survive, including intellectual property, disclaimers, liability limits, indemnity, and governing law.
16. Governing law and disputes
These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. Subject to any mandatory consumer right, the courts located in British Columbia will have exclusive jurisdiction over disputes arising from the website or these Terms, and you submit to their jurisdiction.
Before filing a claim, we encourage you to contact us and attempt to resolve the issue informally. Nothing in this section prevents either party from seeking urgent injunctive relief or using a tribunal or process that applicable law makes available.
17. General terms
If any provision is held invalid or unenforceable, it will be limited or severed to the minimum extent necessary and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a reorganization, financing, sale, or transfer of our business. These Terms, the Privacy Policy, and any applicable separate agreement form the entire agreement concerning their subject matter.
18. Changes to these Terms
We may update these Terms to reflect changes to the website, services, or law. The “Last updated” date identifies the current version. Material changes will receive additional notice where required. Continued use after an updated version takes effect means you accept it; if you do not agree, stop using the website.
